These Terms & Conditions of Sale (“Terms”) apply to the sale, design, supply, installation and servicing of solar photovoltaic (PV) systems, hybrid/battery storage and related products and services (“Goods and Services”) by PowerGrid Solar, a business of JSK Retail Group Pty Ltd (ABN 55 647 993 646) (“we”, “us”, “our”) to you (“you”, the customer). By accepting a quotation from us, you agree to these Terms. Where you sign a separate written sales agreement with us, that agreement and these Terms are read together; if there is any inconsistency, the signed sales agreement prevails.
1. Quotations and acceptance
- Quotations are valid for 30 days from the date issued unless stated otherwise.
- A quotation is an estimate based on the information available at the time, including a remote or on-site assessment. We may revise it if a physical site inspection, switchboard or structural assessment, or network/grid-connection approval shows that additional work, equipment or upgrades are required.
- Advertised package pricing is based on a standard single-storey tin roof with a single-phase meter in the Sydney metro area, after STC discount, and is subject to eligibility, terms and approvals. Your final price may differ following assessment.
- A binding agreement is formed when you accept our quotation in writing (including electronically).
2. Pricing, rebates and STCs
- Prices are in Australian dollars and, unless stated otherwise, include GST.
- Where the price is reduced by the value of Small-scale Technology Certificates (STCs) under the federal Small-scale Renewable Energy Scheme (SRES), or by a battery incentive (for example the federal Cheaper Home Batteries Program) or a NSW Virtual Power Plant (VPP) incentive, you assign the right to create and trade those certificates or incentives to us (or our nominated agent) in return for the upfront discount applied.
- STC numbers and values change with the market and with the legislated wind-down of the SRES toward 2030. If certificate values or your eligibility change before installation, we will advise you and the price may be adjusted — we will not change the price without your agreement.
- There is no NSW state solar panel rebate. Any rebate or incentive figures are estimates only and are subject to the rules and funding of the relevant scheme.
3. Site access and your responsibilities
You agree to:
- provide safe, clear and timely access to the site, roof, switchboard and meter;
- disclose known hazards (for example asbestos, fragile roofing, structural issues or prior wiring faults);
- obtain any body corporate/strata, landlord or heritage consent that applies to your property; and
- ensure the existing electrical installation is safe and compliant. Pre-existing defects may be quoted separately for remediation.
4. Payment
- No deposit is required. The full price is payable on completion of the installation, unless a different arrangement is set out in your sales agreement.
- Where finance is used, payment terms are governed by your agreement with the finance provider. We are not the credit provider.
- Title to the Goods passes to you only when we receive payment in full. Risk passes to you on delivery to your premises.
5. Cooling-off rights
If your agreement is an unsolicited consumer agreement under the Australian Consumer Law (ACL) — broadly, where the sale resulted from us approaching you rather than you approaching us — you have a cooling-off period of 10 business days in which you may cancel without penalty. We will tell you in writing if this applies and how to exercise the right.
6. Installation, standards and grid connection
- Work is carried out by appropriately licensed and accredited personnel in line with the applicable Australian Standards (including AS/NZS 5033 for PV arrays, AS/NZS 4777 for inverters and AS/NZS 5139 for batteries), the NSW Service and Installation Rules, and your distribution network's requirements (Ausgrid, Endeavour Energy or Essential Energy).
- Grid-connected systems need network approval to connect and to export. Approval, export limits and metering changes are determined by your network and retailer, not by us, and their timeframes are outside our control.
- Installation dates are estimates. We are not liable for delays caused by weather, network approvals, product supply or other matters beyond our reasonable control.
7. Variations
If the scope changes after acceptance (for example switchboard upgrades, additional tilt frames, asbestos handling or trenching), we will provide a written variation. Additional work will not proceed without your approval of the variation and any associated cost.
8. Warranties and consumer guarantees
Our products carry manufacturer warranties, and our installation work carries a 5-year workmanship warranty, as set out in our Warranty Policy. Nothing in these Terms excludes, restricts or modifies the consumer guarantees that apply automatically under the Australian Consumer Law — those guarantees cannot be contracted out of, and our warranties are provided in addition to them.
9. Cancellation and refunds
- If you cancel after any cooling-off period (or where none applies), we may retain or charge a reasonable amount for costs already incurred (for example design, certificates, restocking or scheduled labour), as set out in your sales agreement.
- We may cancel where a site is unsafe, where network approval is refused, or where required pre-conditions are not met; in that case we refund amounts paid, less any reasonable costs incurred for work properly performed.
10. Liability
To the extent permitted by law, and subject to clause 8, our liability for failing to meet a consumer guarantee (other than a guarantee as to title) is limited, at our option, to re-supplying the Goods or Services or paying the cost of re-supply. We are not liable for indirect or consequential loss, including loss of expected energy savings, feed-in tariff revenue or profit.
11. Privacy
We handle personal information in line with our Privacy Policy and the Privacy Act 1988 (Cth).
12. Complaints and dispute resolution
If you are unhappy with any aspect of our Goods or Services, please follow our Complaints Policy. Nothing in these Terms limits your right to escalate a matter to NSW Fair Trading, the Energy & Water Ombudsman NSW (EWON) or another relevant body.
13. Governing law
These Terms are governed by the laws of New South Wales, and you submit to the non-exclusive jurisdiction of the courts of that State.
14. Changes to these Terms
We may update these Terms from time to time. The version in force when you accept a quotation applies to that transaction.
